Although the Attorney General stood by his previous decision to prosecute Khalid Sheikh Mohammed and four others in federal court and said the DOJ had a "powerful case" against the men, the National Defense Authorization Act, which became law over Mr. Holder's objections in December and prohibits use of funds to move defendants from Guantanamo Bay to the United States, led to the transfer of the case to the DOD.
