ESTATE OF JOSEPHINE DEGAETANO, Deceased (17/1435) — In this application by the decedent's daughter for the issuance of letters of administration, the decedent's two sons consent to the application and jurisdiction was obtained over the spouse, who is alleged to be under a disability. It would appear that if disability caused the spouse's default, he would be ineligible to serve as the fiduciary of the estate. Of course, if appropriate, a guardian ad litem shall be appointed for the spouse in any future accounting or other proceeding.
