- Surrogate's Court, Bronx County
- Jan 30 2017 (Date Decided)
- Surrogate Malave-Gonzalez
ESTATE OF BERTHA JAGASSAR, Deceased (16/1818) — On an adjourned return date of this application by a son of the decedent seeking letters of administration, the decedent's other son appeared and sought to consult with an attorney, and the decedent's remaining distributee, a daughter, consented to the application. Counsel for the petitioner indicated on the record in open court that a delay would cause harm to the estate and a fiduciary is required to marshal estate assets and properly manage realty, including collecting rents and paying necessary expenses. Based upon this state of the record, the court indicated on the record in open court that temporary letters would issue with appropriate restrictions and the matter was otherwise adjourned to March 2, 2017.
