The guardian ad litem in this matter cross-moves seeking interim fees and disbursements for appearing at 1404 examination previously ordered by the court. On a similar prior application the court directed the parties to appear for the continuation of the 1404 examination on March 27, 2013. (Matter of Hoffer, NYLJ, Mar. 18, 2013, at 18, col 4). All of the parties but the petitioner appeared on the aforesaid date, and this nonappearance gives rise to the cross motion. The petitioner indicates his counsel did not receive notice of the court's prior decision directing all to appear for the conclusion of the 1404 examinations. At this juncture it is clear that the examinations must conclude. Accordingly this decision constitutes the order of the court directing the parties to continue said examination commencing on June 3, 2013 at 10 a.m., and to be continued each day thereafter until its conclusion. The examination is to occur in the Bronx County Courthouse, Room 328, or at any other location and time agreed upon the parties. The cross motion is denied without prejudice to the guardian ad litem resubmitting the time and disbursements sought with his final affirmation of services prior to the court fixing his fee.</description>

Burger heaven, 88 ad3d 591 [1st dept 2011]; matthews v. Vlad restoration ltd., 74 Ad3d 692 [1st dept 2010]; schulman v. Old navy/ gap, inc., 45 Ad3d 475 [1st dept 2007]). In opposition, plaintiff failed to raise a triable issue of fact. The fact that the support became obscured from plaintiff's view after she walked to a point where she was inches in front of the fruit display did not render the condition one which was hidden or obscured (compare lehr v. Mothers work, inc., 73 Ad3d 564 [1st dept 2010]). This constitutes the decision and order of the supreme court, appellate division, first department.</description>
