ESTATE OF VALKO RANGELOV PETROV, also known as VALKO R. PETROV, also known as VALKO PETROV, Deceased — The administrator, the decedent's father, seeks to compromise claims arising from the decedent's death and judicially account for the settlement proceeds, a portion of which is being held in escrow by counsel for the administrator, and a no-fault death benefit.

The decedent died intestate on January 3, 2011, allegedly as the result of injuries sustained as a passenger in a motor vehicle accident. The decedent's distributees are his parents. Dartmouth-Hitchcock Medical Center and Dartmouth-Hitchcock Clinic, Capital One and Dell Financial Services LLC were served with process seeking to disallow any claim that they might have against these proceeds, and they all defaulted. Under the circumstances presented, including the consents of the decedent's mother and the New York State Department of Taxation and Finance, the lack of any other unpaid debts or claims presented herein, and that the decedent never regained consciousness after the accident, the court grants the request to allocate the entire settlement proceeds to the wrongful death claim.

Counsel fees are allowed in the sum requested. Disbursements were waived. The net distributable proceeds and the no-fault death benefit may be paid to the decedent's parents in equal shares.
