A Third Department panel ruled unanimously that the alleged inconsistencies in the testimony of a 9-year-old sex abuse victim concerned only "immaterial aspects" of her testimony and found the defense lawyer's "decision not to badger a child victim of sexual abuse...to be a sound trial strategy."
