Breathalyzer Data Is Ruled Nontestimonial

The inspection and calibration of the breathalyzers used to determine if drivers are drunk are nontestimonial, and defendants do not have a constitutional right to cross-examine the technicians who service them, the Court of Appeals ruled yesterday.
