While holding there was sufficient evidence to convict Luis Delgado of second-degree burglary in a bench trial, the Second Department ordered a new trial, finding Delgado's defense attorney should have followed through on a request for a determination about how far prosecutors could go in questioning Delgado on prior burglary convictions after he testified in his own behalf.
