In other recent Fourth Department criminal cases, the court said a judge in Monroe County erred in permitting a defendant to proceed pro se without undertaking the requisite "searching inquiry," and held that an Onondaga County judge properly refused to suppress evidence discarded by a suspect fleeing from police.
