Mortgage Lender Wins Restitution Under Exception in CPLR 5523

A man who sold a property that an appellate court subsequently ordered turned over to his wife may still be ordered to pay the value of the property as restitution to the mortgage lender under a little-used civil procedure rule, a Suffolk judge has ruled.
