The possibility of a gun left in public, the Second Circuit panel said, "created an objectively reasonable need for officers to protect the public safety, and this allowed the officers to act under the 'public safety' exception to the Fifth Amendment requirement that they inform defendant Lamont Ferguson of his rights."
