A splintered Court of Appeals yesterday upheld a man's conviction for the rape of his 13-year-old daughter, holding that the lower court properly precluded him from questioning the girl about her sexual activity and provocative social media postings. In another case, the court said for the first time that the decision "whether to seek a jury charge on lesser-included offenses is a matter of strategy and tactics which ultimately rests with defense counsel."
