County Court Judge Frank LaBuda said the failure to timely disclose exculpatory and impeaching materials "resulted in substantial and irreparable harm to the defendant's case due to defense counsel's inability to properly investigate witnesses and the alleged victim, and to properly explore other trial strategy and theories of defense."
