Plaintiffs' counsel Worby Groner Edelman & Napoli Bern is also appealing a part of Judge Hellerstein's order denying them the right to collect a 25 percent fee from the payout. The $5 million was due if the number of new claims filed in five years remained under 120, a number that was not reached if withdrawn claims are not counted.
