A divided First Department has affirmed the dismissal of a lawsuit filed by an employee of an Italian bank's New York branch who went on disability leave and was later terminated, ruling that the employee gave up any claim when he sent the bank a "hostile and imperious" letter threatening a lawsuit shortly before his termination.
