The Second Circuit said yesterday that Eastern District Judge Joseph Bianco lacked subject matter jurisdiction over the dispute, which began in 2003 when the Shinnecock Indian Nation contracted for the construction of a 61,000-square-foot casino and began clearing land without approval from Southhampton.
