While the New York City Transit Authority has no special duty to protect intoxicated patrons, a Brooklyn judge has refused to dismiss a lawsuit by the widow of an extremely intoxicated passenger who died after he stayed on a subway train in violation of authority rules as it switched tracks at the end of its run.
