Regulators Continue Heightened Antitrust Scrutiny of Patent Holders

Jeffrey D. Sullivan, who was a partner at Baker Botts, and Reiko Manabe, a member of the FUJIFILM Corporation Intellectual Property Legal Division, write that President Obama's election was accompanied by promises of heightened antitrust enforcement, and his first DOJ antitrust chief signaled the possibility of greater enforcement where intellectual property is at issue. That attention to intellectual property/patent holders was not merely rhetorical, but the administration's policy toward patent transactions shows a perhaps surprising amount of continuity with that of its predecessors.
