Judges Barrington D. Parker and Rosemary S. Pooler yesterday said a provision of the United States Leadership Against HIV/AIDS, Tuberculosis, and Malaria Act of 2003 that requires NGOs to have an explicit policy opposing prostitution and trafficking "falls well beyond what the Supreme Court and this Court have upheld as permissible conditions on the receipt of government funds."
