A former consultant at an online investment company has successfully argued that, as a result of errors made by the district court judge overseeing his breach of contract case, he is entitled to a new trial. The panel specifically found fault with some evidentiary rulings and jury instructions, and said the former Wit Capital Group employee might be entitled to more than the $400,000 in damages a jury awarded him.
