Chaikin, J.), entered December 7, 2010. The order, insofar as appealed from, denied the branches of defendants' motion seeking to dismiss the consolidated action pursuant to CPLR 3211 or, in the alternative, for summary judgment dismissing the consolidated action, and for the imposition of sanctions.
