JOSEPH R. CEBRON APPELLANTSres, v. CEM TUNCOGLU res, TOWN OF SOMMERS, res-res — Motion by the respondents Leo Gormley and Y. Michiko Gormley to enlarge the record on an appeal and cross appeal from an order of the Supreme Court, Westchester County, dated December 21, 2011, to include the transcript of oral argument of the underlying motion, and to enlarge the time to serve and file a brief.

Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is

ORDERED that the branch of the motion which is to enlarge the record is denied; and it is further,

ORDERED that the branch of the motion which is to enlarge the time to serve and file a brief is denied as unnecessary as the brief was timely served and filed.
