PROCEEDING FOR REMOVAL OF BAHMAN MOSSAVAR-RAHMANI AS TRUSTEE OF A TRUST FOR THE BENEFIT OF NICHOLAS MOSSAVAR RAHMANI UNDER THE LAST WILL AND TESTAMENT OF SHAHIN MOSSAVARRAHMANI (2030/A/03) — At the call of the calendar in this proceeding to remove the trustee of a trust under the will of Shahin Mossavar-Rahmani and to appoint a successor trustee, the respondent trustee did not appear. Based on the allegations of the petition and the trustee's default, the court temporarily suspended the trustee's letters pending a hearing on his removal (SCPA 711).

Letters of temporary trusteeship shall issue to Bijan Mossavar-Rahmani upon his duly qualifying according to law. Bahman Mossavar-Rahmani is directed to turn over all trust records and assets in his possession or under his control to the temporary trustee upon his receipt of letters.

A hearing is scheduled for February 7, 2013, at 11:00 A.M. in room 509 of this courthouse to determine whether the letters of trusteeship issued to Bahman Mossavar-Rahmani should be revoked.

Settle order on all parties.
