ORDERED that the of this Court dated December 27, 2012, in the above-entitled appeal from an order of the Supreme Court, Queens County, entered May 17, 2013, is amended by deleting from the second paragraph thereof the words "no papers having been filed," and substituting therefor the words "the papers filed".

ENG, P.J., MASTRO, RIVERA, SKELOS and DILLON, JJ., concur.
