ESTATE OF VINCENT BALLSCHMIEDER Deceased (438/A/12) — Objections to the instrument offered for probate of the above caption decedent have been filed in this Court. Further, an affirmation from Edward A. DiTomasso, Esq., of DiTomasso & DiTomasso, attorneys for the probate petitioner, has also been received by the Court stating that all interested parties under the Will have appeared by counsel and, therefore, citation under SCPA 1411 is not required. Edward A. DiTomasso, Esq., requests that the matter be restored to the Court's Calendar for further disposition.

Accordingly, the matter is restored to the Court Calendar for January 9, 2013 at 9:30 a.m.

The Clerk of the Court is directed to mail a copy of this Decision to all counsel who have appeared in this proceeding.

This Decision shall constitute the Order of this Court.
